But judge says GMI may not be able to claim full costs of successful appeal against OFT fines
GMI can claim costs of its appeal against the Office of Fair Trading according to a judge, but it may not be able to claim the full amount it seeks.
Following GMI’s successful appeal against the OFT fines in April the contractor sought a court order requiring OFT pay costs of £285,649.47.
The OFT said the amount claimed was excessive and referred to the claim of £32,702.90 by AH Willis and Sons Limited in a similar case.
The judge at the Competition Appeal Tribunal has asked a cost judge of the Senior Courts to assess the final amount that should be awarded to GMI.
