Judgment delivered 12 November 2021
On 11 July 2018 Geo entered into an agreement to supply to Readie GSB Type 1 aggregate for £19.50 per tonne to be delivered to a site in Bedfordshire. On the same day, Readie completed a credit agreement with Geo incorporating Geo’s standard terms and conditions of sale, which in clause 4.1 provided that payment was to be made in full “without any deduction or withholding whatsoever on any account” by the end of the calendar month following the month in which the invoice was dated.
