Shy Jackson (25 January, page 60) refers to the government’s renewed interest in the Law Commission proposals on reform of the law of time limitation.

These proposals include a long-stop – the final date on which something such as a legal right expires – of 10 years, which crucially can be varied by agreement.

The concern of the Construction Industry Council (and the Construction Confederation) was expressed at the time: will clients seek to extend the 10 years to an uninsurable period?
