Rudi Klein asserted that “traditional procurement methods are so needlessly wasteful that a consultant or solicitor who advises a client to adopt them may be guilty of negligence”
The late Duncan Wallace, who wrote the later editions of Hudson’s Building and Engineering Contracts, made a similar well-publicised statement more than 25 years ago, to the effect that any architect who advises a client to use a JCT contract may be guilty of negligence. Duncan Wallace’s prediction never came to pass and I feel the same fate awaits Rudi’s suggestion.
