It was interesting to see that adjudication for householders carrying out construction works on their properties is catching on (9 May, page 15).
The JCT, as long ago as 1999, provided for an adjudication procedure that required adjudicators to give their decisions within 21 days of appointment. This procedure has been available since then, with publication of the JCT’s Building Contract for a Homeowner/Occupier and the Building Contract and Consultancy Agreement for a Homeowner/Occupier.
The RICS, RIBA and NSCC run the adjudication service, which additionally provides a relatively inexpensive and efficient means of resolving problems.
