The Construction Industry Council has raised concerns about the proposed European Union Directive on Services in the Internal Market, which would mean consultants from other countries would be subject only to the law of their home country.
The CIC said the proposal could mean that a Spanish consultant working on a project in England was “subject to the law of Spain not England”. In addition, it claimed that under the directive, the visiting service provider’s liability would be governed by the law of their home state, which could result in a nasty surprise for their employer.
The industry body said it welcomed the aim of the directive to enable consultants to work freely across borders but felt that it needed some amendment so as not to cause chaos.
The CIC made its concerns known at the House of Lords inquiry into the proposal on 7 March.
