Prime Minister's wife will not defend Fawziah in the Metramac court case

The Federal Court in Malaysia has ruled out Cherie Booth's involvement in the high profile case involving Fawziah Holdings and Metramac Corporation.

Fawziah has argued that Booth's expertise, as a lawyer, is crucial because the case involves public law issues new to Malaysian courts. However, based on the evidence, the court has decided that local lawyers will be more suited to the job.

Chief justice, Tun Ahmad Fairuz Sheikh Abdul Halim said: "We agree with the High Court judge that local advocates and solicitors are equipped to handle the matter."

The case involves construction company, Fawziah, seeking compensation from a former subsidiary, Metramac, over a road construction project. Last January the Court of Appeal ruled that compensation should be paid but the decision was challenged on the grounds of alleged bias.

Documents submitted to the court said: "Although the applicant (Booth) does possess impressive credentials and is an eminent QC, she does not specialise, nor has she distinguished herself in this particular area of law that will be adjudicated on before the Federal Court."

The Metramac appeal date has now been fixed for July 10.
